1. Information We Collect

Markital does not collect, store, or transmit any personally identifiable information. When you use our tools, the data you enter (brand names, copy briefs, keywords, uploaded files) is processed entirely in your browser session and sent directly from your browser to the Google Gemini API. This data is not stored on our servers.

2. API Keys

Some tools require a Google Gemini API key. These keys are entered by you in the browser, stored temporarily in your browser's session or local storage, and sent directly to Google's API. Markital never transmits or stores your API key on our servers. You are responsible for the security and usage of your own API keys.

3. Uploaded Files

Tools like Hookly and SEOPen allow you to upload brand documents (PDF, DOCX, TXT) and creative assets (images, video). These files are encoded in your browser's memory, sent to the Gemini API as part of the request, and immediately discarded from memory when the session ends. We do not store uploaded files on any server.

4. Local Storage

Markital uses browser local storage exclusively to remember your language preference (EN or ES) across sessions. No personal or behavioral data is stored in local storage.

5. Analytics and Advertising

Markital may display Google AdSense advertisements. Google AdSense uses cookies to serve personalized ads based on your browsing history. You can opt out of personalized advertising by visiting Google's Ads Settings. We may also use Google Analytics to understand aggregate traffic patterns. Google Analytics data is anonymized and does not identify individual users.

6. Cookies

Markital itself does not set cookies beyond those required by third-party services (Google AdSense, Google Analytics). You can disable cookies in your browser settings, though this may affect the functionality of third-party advertising.

7. Third-Party Services

Our tools communicate with the Google Gemini API to generate AI outputs. Your use of these tools is subject to Google's Terms of Service and Privacy Policy. Markital is not affiliated with or endorsed by Google.

8. Children's Privacy

Markital tools are intended for professional marketing use and are not directed at children under the age of 13. We do not knowingly collect information from children.

We may update this Privacy Policy from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the site after changes constitutes acceptance of the updated policy.

Terms of Use

1. Acceptance

By using Markital tools, you agree to these Terms of Use. If you do not agree, do not use the tools.

2. Permitted Use

Markital tools are provided for lawful marketing and content creation purposes. You may not use the tools to generate spam, misleading advertising, content that violates third-party intellectual property rights, or content targeting minors inappropriately.

3. AI-Generated Content

All outputs are generated by AI and provided "as is" without warranty of accuracy or fitness for a specific purpose. You are solely responsible for reviewing, editing, and approving any AI-generated content before publishing or using it in marketing materials.

4. API Key Responsibility

You are responsible for obtaining and managing your own Google Gemini API key and for all API usage charges incurred under your key. Markital accepts no responsibility for API costs or usage overages.

5. Limitation of Liability

Markital is provided as a free service. To the maximum extent permitted by law, Markital and its creators are not liable for any direct, indirect, incidental, or consequential damages arising from use of the tools, including campaign performance, legal compliance issues, or decisions made based on AI-generated outputs.

6. Intellectual Property

The Markital interface, design, and code are the property of their creators. AI-generated outputs belong to the user who generated them, subject to Google's Gemini API terms of service regarding AI-generated content ownership.
